Terms & Conditions – Apollo eSIM

1. Introduction

Welcome to Apollo eSIM, operated by Flex Group (“Company,” “we,” “our,” or “us”). By using our website, mobile application, or by purchasing, activating, or using our eSIM services, you agree to be bound by these Terms & Conditions (“Terms”).

2. Use of Service

2.1. Apollo eSIM provides prepaid eSIM and mobile data solutions for personal and lawful use only.

2.2. You may not misuse, resell, or exploit the service, including but not limited to engaging in spam, fraud, hacking, or any illegal activities.

2.3. You must be at least 18 years old and use an eSIM-compatible device.

2.4. Your data balance and validity period are displayed in your customer account

3. Account and Purchases

3.1. You must provide accurate and up-to-date information during purchase and activation.

3.2. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

3.3. Payments for internet data plans must be made in accordance with the rates specified on the website.
3.4. All payments are secure and processed by trusted third parties.

3.5.Except as required under applicable consumer protection laws, all sales are final and non-refundable.

4. Cancellation and Refund Policy

4.1. No refunds are available once an eSIM is activated or a plan has started, unless required by law.
 4.2. Before activation, you may be eligible for a credit if:

●     The eSIM cannot be delivered due to technical issues under our control, or

●     The eSIM is defective and confirmed by our support team.

 4.3. Any claim must be submitted before the plan expiry date and confirmed by Apollo eSIM support.
 4.4. This policy does not affect your statutory rights as a consumer under applicable laws.

5. Service Availability

Service availability, quality, and speed depend on local networks and roaming partners. We do not guarantee uninterrupted connectivity.

6. Fair Usage

Our plans are subject to a Fair Usage Policy. Excessive, abusive, fraudulent, or automated use (including reselling or data scraping) may result in suspension or termination without prior notice

7. Privacy Policy

Your use of the Website and the Application is governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your personal data in compliance with Canadian federal law (PIPEDA), Quebec law (Law 25) and other applicable international privacy laws.

8. Limitation of Liability

8.1. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use or inability to use the services.

8.2. Our maximum aggregate liability is limited to the total amount you paid for the services in the 12 months preceding the claim.

8.3. Nothing in these Terms excludes or limits rights and remedies you may have under applicable consumer protection laws.

9. Intellectual Property

All content, trademarks, and materials on the Apollo eSIM website and application are owned by Flex Group or its licensors. Unauthorized use, reproduction, or modification is strictly prohibited.

10. Changes to Terms

We may update these Terms from time to time. Any changes will be published on our website with a new effective date. Continued use of our services after changes constitutes acceptance of the revised Terms.

11. Termination

We reserve the right to terminate or suspend your access to the Website, Application, or our Services if you breach these Terms and Conditions.

12.1. These Terms are governed by the laws of the Province of Quebec, Canada, and, where applicable, the federal laws of Canada.

12.2. Any dispute will be subject to the jurisdiction of the civil courts of Quebec (Montreal district), unless mandatory consumer protection laws in your country of residence provide otherwise.
